Terms of Sale

1. Purpose and scope
These Terms of Sale ("ToS") apply to any subscription to the Plat du Jour service offered by the publisher. They are exclusively intended for professionals (restaurateurs, catering establishments, hotels, bars, caterers) within the meaning of the preliminary article of the French Consumer Code.
Any subscription entails unreserved acceptance of these ToS, which prevail over any other conditions, unless expressly agreed otherwise in writing.
2. Seller
The service is marketed by Plat du Jour, reachable at contact@platdujour.app. The publisher's full contact details are available in the legal notices.
3. Description of plans
Plat du Jour offers three monthly subscription plans, with no commitment:

Full feature details for each plan are available on the Pricing page. Under the Growth plan, each additional restaurant beyond the 3 included is billed at €20 excl. tax/month.
4. Free trial period
Every new subscription includes a free 14-day trial on the chosen plan, with no credit card required. At the end of this period, the subscription becomes paid only if the Client actively confirms their subscription and provides a valid payment method.
5. Order and contract formation
Subscriptions are made online from the Client's dashboard or, upon request, through the sales team. The contract is formed upon the Client's validation of their payment method and acceptance of these ToS. A confirmation email is sent summarizing the subscribed plan, its price, and effective date.
6. Prices
Prices are expressed in euros, excluding taxes. Applicable VAT is added at the time of invoicing according to the legislation in force on the invoicing date. Prices may be revised at any time; any price change is notified to the Client at least 30 days before taking effect and only applies to the next billing cycle.
7. Payment terms
Payment is made by credit card or SEPA direct debit, through a secure payment provider. Billing is monthly, automatically debited on the subscription anniversary date. Invoices are made available in the Client's account.
In case of payment failure, Plat du Jour reserves the right, after a reminder left unanswered for 7 days, to suspend access to the service until regularization, without such suspension releasing the Client from their payment obligations.
8. Duration, renewal, and termination
The subscription is taken out for an initial period of one month, tacitly renewed for successive one-month periods, with no commitment. The Client may terminate at any time from their dashboard or by email to contact@platdujour.app.
Termination takes effect at the end of the current monthly period. No pro rata refund is granted for the period already started. The Client's data remains accessible for 30 days after termination, then is deleted, unless legal retention obligations apply.
9. Plan changes
The Client may change plans (upgrade or downgrade) at any time from their dashboard. In case of an upgrade, the new rate applies immediately pro rata for the remaining days. In case of a downgrade, the new rate applies at the next billing cycle.
10. Right of withdrawal
In accordance with Article L.221-3 of the French Consumer Code, professionals whose contract falls within the scope of their main activity do not benefit from the right of withdrawal. The 14-day free trial provided in Article 4 nevertheless serves as a no-commitment test period.
11. Client obligations
The Client undertakes to use the service in accordance with the Terms of Use, to provide accurate information, to keep their payment methods up to date, and not to compromise the integrity of the service (reverse engineering, mass scraping, intrusion attempts, circumvention of technical limits).
12. Service level and support
Plat du Jour commits to providing a service with a target of 99% monthly availability, excluding planned interruptions or force majeure. Support is provided according to the following response times:
- Menu plan: email support within 48 business hours
- Reputation plan: priority support within 24 business hours
- Growth plan: dedicated support within 4 business hours and 1:1 onboarding
13. Liability
Plat du Jour provides the service under a best-efforts obligation. The publisher shall not be held liable for indirect damages (loss of revenue, loss of customers, damage to image) or for malfunctions resulting from third-party services (messaging platforms, social networks, search engines).
In any event, Plat du Jour's liability, if engaged, is strictly limited to the amount excl. tax actually paid by the Client during the twelve (12) months preceding the triggering event.
14. Force majeure
Neither party shall be held liable for any failure to fulfill its obligations resulting from force majeure as defined in Article 1218 of the French Civil Code, including widespread Internet outage, failure of a critical third-party provider (Convex, Bunny CDN, AI providers, messaging services), government action, or natural disaster.
15. Personal data
In the performance of the contract, Plat du Jour acts as a data processor within the meaning of Article 28 of the GDPR for end-customer data that the Restaurateur may collect (WhatsApp messages, reviews, orders). A Data Processing Agreement (DPA) can be signed upon simple request to contact@platdujour.app.
16. Applicable law and jurisdiction
These ToS are governed by French law. In case of dispute, the parties shall endeavor to find an amicable solution. Failing that, exclusive jurisdiction is attributed to the competent French courts, notwithstanding plurality of defendants or warranty claims.
